Privacy Policy

This Privacy Policy for personal data (hereinafter referred to as the Privacy Policy) applies to all information that the online store UASTAL, located at the domain name uastal.com, may obtain about the User while using the online store’s website, programs, and products.


1. DEFINITIONS


1.1. The following terms are used in this Privacy Policy:


1.1.1. “Administration of the online store website (hereinafter — Site Administration)” — authorized employees responsible for managing the site on behalf of the sole proprietor Valentyn Ivanovych Storozhuk, who organize and (or) carry out the processing of personal data, as well as determine the purposes of processing personal data, the scope of personal data to be processed, and the actions (operations) performed with personal data.


1.1.2. “Personal data” — any information relating directly or indirectly to an identified or identifiable natural person (subject of personal data).


1.1.3. “Processing of personal data” — any action (operation) or set of actions (operations) performed using automation tools or without them, involving personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, and destruction of personal data.


1.1.4. “Confidentiality of personal data” — a mandatory requirement for the Operator or other person who has gained access to personal data not to allow its dissemination without the consent of the subject of personal data or other legal grounds.


1.1.5. “User of the online store website (hereinafter — User)” — a person who has access to the Site via the Internet and uses the online store’s website.


1.1.6. “Cookies” — a small piece of data sent by a web server and stored on the user’s computer, which the web client or web browser sends back to the web server in an HTTP request each time it tries to open a page of the corresponding website.


1.1.7. “IP address” — a unique network address of a node in a computer network built on the IP protocol.




2. GENERAL PROVISIONS


2.1. Use of the online store’s website by the User constitutes agreement with this Privacy Policy and the terms of processing the User’s personal data.


2.2. If the User disagrees with the terms of the Privacy Policy, they must stop using the online store’s website.


2.3. This Privacy Policy applies only to the online store website ____. The online store does not control and is not responsible for third-party websites that the User may visit via links available on the online store’s site.


2.4. The Site Administration does not verify the accuracy of personal data provided by the User of the online store’s website.




3. SUBJECT OF THE PRIVACY POLICY


3.1. This Privacy Policy establishes the obligations of the online store’s Site Administration to not disclose and ensure the protection of confidentiality of personal data that the User provides at the request of the Site Administration during registration on the online store’s website or when placing an order for the purchase of Goods.


3.2. Personal data permitted to be processed under this Privacy Policy is provided by the User by filling out the registration form on the uastal.com online store website in the “Place Order” section and includes the following information:

  • 3.2.1. User’s surname, first name, patronymic;

  • 3.2.2. User’s contact phone number;

  • 3.2.3. Email address.

3.3. The online store also protects data automatically transmitted when viewing ad blocks and when visiting pages with an installed statistics script (“pixel”):


  • IP address;

  • Cookie information;

  • Browser information (or other software providing access to ads);

  • Access time;

  • Address of the page containing the ad block;

  • Referrer (previous page address).

3.3.1. Disabling cookies may result in the inability to access parts of the online store’s website that require authorization.


3.3.2. The online store collects statistics on IP addresses of its visitors. This information is used to identify and solve technical problems and to monitor the legality of financial transactions.


3.4. Any other personal information not specified above (purchase history, browsers and operating systems used, etc.) is securely stored and not disclosed, except in cases provided for in clauses 5.2. and 5.3. of this Privacy Policy.




4. PURPOSES OF COLLECTING THE USER’S PERSONAL INFORMATION


The Site Administration may use the User’s personal data for:


4.1.1. Identifying the User registered on the online store’s website to place an order and (or) conclude a distance sales contract with sole proprietor Ivan Volodymyrovych Storozhuk.


4.1.2. Providing the User with access to personalized resources of the online store website.


4.1.3. Establishing feedback with the User, including sending notifications, requests related to use of the site, provision of services, processing User requests and applications.


4.1.4. Determining the User’s location for security and fraud prevention.


4.1.5. Confirming the accuracy and completeness of personal data provided by the User.


4.1.6. Creating an account for making purchases, if the User has consented to account creation.


4.1.7. Notifying the User about the status of their Order.


4.1.8. Processing and receiving payments, confirming tax or tax benefits, disputing a payment, determining the User’s eligibility for credit.


4.1.9. Providing the User with effective customer and technical support in case of problems with the online store website.


4.1.10. With User consent, providing product updates, special offers, pricing information, newsletters, and other information on behalf of the online store or its partners.


4.1.11. Conducting promotional activities with the User’s consent.


4.1.12. Providing the User with access to partner websites or services of the online store in order to obtain products, updates, and services.




5. METHODS AND TERMS OF PROCESSING PERSONAL INFORMATION


5.1. Processing of the User’s personal data is carried out without limitation of time, by any lawful means, including in personal data information systems using automation tools or without them.


5.2. The User agrees that the Site Administration has the right to transfer personal data to third parties, in particular to courier services, postal organizations, telecommunications operators, solely for the purpose of fulfilling the User’s order placed on uastal.com, including delivery of the Goods.


5.3. The User’s personal data may be transferred to authorized state authorities of Ukraine only on the grounds and in the manner established by the legislation of Ukraine.


5.4. In the event of loss or disclosure of personal data, the Site Administration shall inform the User of the loss or disclosure.


5.5. The Site Administration takes necessary organizational and technical measures to protect the User’s personal information from unlawful or accidental access, destruction, modification, blocking, copying, distribution, as well as from other illegal actions of third parties.


5.6. The Site Administration, together with the User, shall take all necessary measures to prevent damages or other negative consequences caused by loss or disclosure of the User’s personal data.




6. OBLIGATIONS OF THE PARTIES


6.1. The User shall:


6.1.1. Provide information about personal data necessary to use the online store website.


6.1.2. Update, supplement the provided personal data if this information changes.


6.2. The Site Administration shall:


6.2.1. Use the received information solely for the purposes specified in section 4 of this Privacy Policy.


6.2.2. Keep confidential information secret, not disclose it without prior written consent of the User, and not sell, exchange, publish, or disclose transferred personal data by other possible means, except for clauses 5.2. and 5.3. of this Privacy Policy.


6.2.3. Take precautions to protect the confidentiality of the User’s personal data in accordance with the procedures commonly used in business turnover to protect such information.


6.2.4. Block personal data relating to the relevant User from the moment of appeal or request by the User or their legal representative, or an authorized body for the protection of personal data subjects, during the verification period, in case of detection of false personal data or unlawful actions.




7. LIABILITY OF THE PARTIES


7.1. The Site Administration, which has not fulfilled its obligations, shall be liable for losses incurred by the User due to unauthorized use of personal data, in accordance with the legislation of Ukraine, except in cases provided for in clauses 5.2., 5.3., and 7.2. of this Privacy Policy.


7.2. In case of loss or disclosure of Confidential Information, the Site Administration is not liable if such confidential information:


7.2.1. Became public domain before its loss or disclosure.

7.2.2. Was received from a third party before it was obtained by the Site Administration.

7.2.3. Was disclosed with the User’s consent.




8. DISPUTE RESOLUTION


8.1. Before filing a lawsuit regarding disputes arising from the relationship between the User and the Site Administration, it is mandatory to submit a claim (written proposal for voluntary settlement of the dispute).


8.2. The recipient of the claim shall, within 30 calendar days from the date of receipt, provide the claimant with a written response on the results of the review.


8.3. If agreement is not reached, the dispute shall be referred to a judicial authority in accordance with the current legislation of Ukraine.


8.4. This Privacy Policy and relations between the User and the Site Administration are governed by the current legislation of Ukraine.




9. ADDITIONAL CONDITIONS


9.1. The Site Administration has the right to make changes to this Privacy Policy without the User’s consent.


9.2. The new Privacy Policy comes into force from the moment it is posted on the online store’s website, unless otherwise provided by the new version.
